
NEW DELHI, Sept 24: The Supreme Court on Wednesday directed the National Investigation Agency (NIA) to furnish details regarding the custody of Kashmiri separatist leader Shabir Ahmed Shah in other criminal cases pending against him.
A bench comprising Justices Vikram Nath, Sandeep Mehta, and N V Anjaria noted that Shah is reportedly facing trial in about 24 cases. The court was hearing his plea challenging the Delhi High Court’s June 12 order denying him bail in a terror funding case.
The NIA counsel sought more time to file a counter affidavit. Granting four weeks, the bench directed that the affidavit must specifically include Shah’s custody status in other cases. The matter has now been listed for hearing on October 31.
Earlier, on September 4, the apex court had refused to grant Shah interim bail but issued notice to the NIA. The Delhi High Court, while denying bail, had observed that the possibility of Shah resuming unlawful activities and influencing witnesses could not be ruled out.
Shah, chairman of the Jammu and Kashmir Democratic Freedom Party (JKDFP), was arrested by the NIA on June 4, 2019, in connection with a case registered in 2017 against 12 people for allegedly raising funds through hawala and LoC trade to fuel separatist and militant activities in J&K.
According to the NIA, Shah played a “substantial role” in facilitating separatist movements, glorifying slain militants, and inciting the public with inflammatory speeches. The High Court had also rejected his alternate prayer for house arrest, citing the seriousness of charges.
