
NEW DELHI, Sept 24: The Delhi High Court on Wednesday refused to entertain a PIL seeking the removal of the graves of executed terrorists Mohammad Afzal Guru and Mohammad Maqbool Bhatt from Tihar Jail premises.
A bench of Chief Justice Devendra Kumar Upadhyaya and Justice Tushar Rao Gedela allowed the petitioners to withdraw the plea after their counsel sought permission to re-file it with additional data. The court observed that for a PIL, violation of constitutional or statutory rights must be shown, and no law prohibits burial within prison premises.
The petition was filed by Vishwa Vedic Sanatan Sangh and one Jitendra Singh, claiming the graves act as “radical pilgrimage sites” glorifying terrorism. It sought relocation of the mortal remains to undisclosed sites, citing security risks and provisions of the Delhi Prisons Rules, 2018, which mandate disposal of executed prisoners’ bodies to prevent glorification.
The petitioners argued that presence of these graves undermines national security and public order. However, the bench asked for evidence proving that people were visiting the graves for homage.
The plea compared the case with Ajmal Kasab and Yakub Memon, whose bodies were buried secretly to avoid glorification. While Maqbool Bhatt was hanged in 1984, Afzal Guru was executed in 2013 for his role in the Parliament attack.
