NEW DELHI, Sept 22: The Supreme Court on Monday expressed concern over some High Court judges being unable to deliver on their tasks, stressing the need for performance evaluation and effective self-management systems within the judiciary.
A bench of Justices Surya Kant and N Kotiswar Singh observed, “There are Judges who work day and night and are giving outstanding disposal of cases. But at the same time, some judges unfortunately are unable to deliver — whatever may be the reasons, good or bad.”
The bench clarified that while it does not intend to act like a “school principal,” there must be broad guidelines so that judges know their responsibilities. It cited instances where High Court judges reserved verdicts in criminal appeals involving life and death row convicts but failed to pronounce judgments for years.
Highlighting disparities, the bench said that deciding one criminal appeal in a day is a significant achievement, but in bail matters, handling only one case in a day reflects poor efficiency. It underscored that public expectations from the judiciary require introspection on such practices.
The Supreme Court further emphasized that reasons must follow within five days of pronouncing an operative order, as per earlier judgments of the Apex Court. Justice Kant also noted that some judges have developed a “habit of adjourning cases unnecessarily,” which can damage their image and erode public trust.
Advocate Fauzia Shakil presented data highlighting delays in judgment delivery by some High Courts, while the bench directed her to submit detailed information on reserved cases, pronouncement dates, and verdict uploads within two weeks. Senior advocate Ajit Sinha has been asked to assist in the matter.
