Extension of Remand
Special Judge NIA Act, Jammu, Sandeep Gandotra, allowed the custody of accused Bashir Ahmad Jothatd, son of Lal Din Jothatd of Baisaran (presently Hill Park, Pahalgam, Anantnag), and Parvaiz Ahmad, son of Ghulam Hassan Jother of Batkote, Pahalgam, to be extended beyond the statutory 90 days, up to 180 days under the Unlawful Activities (Prevention) Act (UAPA).
The case, re-registered by the NIA on April 27, 2025 (RC-02/2025/NIA/JMU), stemmed from FIR No. 25/2025 at Police Station Pahalgam. The accused, arrested on June 22, 2025, have been lodged at District Jail Amphalla, Jammu. Their 90-day remand was set to expire on September 19, 2025.
Prosecution’s Arguments
Public Prosecutor Chandan Kumar Singh argued that the investigation remained at a crucial stage, with multiple witness statements under Section 183 BNSS yet to be recorded. The NIA highlighted pending forensic reports from CFSL Chandigarh and NFSU Gandhinagar, DNA profiling of seized blankets, shawls and bedsheets, as well as the recovery of Pakistani phone numbers from the accused. Arms and ammunition seized in a July 28 encounter were also under forensic analysis.
Defence Opposition
Defence counsel Ashwani Kumar opposed the extension, contending that the accused had been in custody for nearly two months without conclusive evidence, and that the NIA had failed to complete its probe within the time already granted.
Court’s Observation
The court dismissed the defence plea, noting that the allegations were of a serious nature and directly linked to national security. “A prima facie case is made out for extension of remand and detention of accused beyond the stipulated period,” Judge Gandotra observed, citing pending forensic reports and crucial witness statements. The court allowed a 45-day extension of remand and directed the investigating officer to complete the probe expeditiously.
